Court in Germany rules facility-related vaccination requirement unconstitutional

The Osnabrück Administrative Court judges Section 20a of the Infection Protection Act (IfSG), as it applied at the end of 2022, to be unconstitutional. The standard violated the fundamental right to physical integrity and professional freedom, the court press office announced on Tuesday (September 3) following a hearing in the case of a nursing assistant. The woman had filed a regulatory action after the Osnabrück district imposed a “ban on entry and activity” against her in 2022 because she did not present “proof of vaccination or recovery”. The trial had already attracted particular attention because the President of the Robert Koch Institute (RKI) Lars Schaade was invited as a witness.
